What are EMCS and GAMMA? Definition

EMCS (Excise Movement and Control System) is the European Union’s IT system for the monitoring and control of movements of excise goods under duty suspension. EMCS centralises the recording of excise product flows (alcohol, tobacco, energy products) moving between authorised economic operators within the Union.

GAMMA is the French access portal to EMCS, allowing French operators to declare and monitor movements of excise products under duty suspension. GAMMA functions as the national interface for managing excise flows, integrating the sending of data to EMCS and the receipt of monitoring information.

EMCS/GAMMA operates according to the principle of conditional duty suspension: excise goods can move between authorised operators without immediate payment of excise duty, subject to the transmission of compliant movement declarations and full tracking of flows. Excise duty only becomes due upon removal from the suspension arrangement (marketing or final use).

The regulatory framework for EMCS/GAMMA is part of the harmonisation of excise formalities within the Union. Each movement of an excise product must be declared and monitored via EMCS/GAMMA in accordance with the obligations defined by the regulations.

Context of use

EMCS/GAMMA applies to all movements of excise products under duty suspension:

• Alcohol movements: circulation of alcoholic products between tax warehouses, authorised producers and commercial operators.
• Tobacco movements: circulation of manufactured tobacco products between authorised sites and distributors.
• Energy product movements: circulation of hydrocarbons, electricity or other products subject to energy excise.
• Cross-border movements: circulation of excise products under suspension between operators located in different Union Member States.
• Removal from suspension: transition to marketing with excise liability.

Practical challenges

The use of EMCS/GAMMA involves strict administrative obligations:

• Mandatory authorisation: only operators authorised by the administration can move excise products under duty suspension via EMCS/GAMMA.
• Advance movement declaration: each movement must be declared via EMCS/GAMMA before dispatch, with the transmission of an electronic administrative document (EAD).
• Full monitoring and traceability: each product flow must be monitored from the point of departure to the point of arrival via EMCS/GAMMA.
• Acknowledgement of receipt: the recipient must confirm receipt of the goods via EMCS/GAMMA, closing the movement.
• Operator responsibility: the authorised operator assumes full responsibility for the compliance of EMCS/GAMMA declarations.
