RCR (registered customs representative)
What is an RCR? Definition
The RCR (registered customs representative) is a natural or legal person previously registered with customs to carry out, on behalf of others, acts and customs formalities provided for by customs regulations.
The RCR can, in particular, prepare and submit customs declarations, transmit the necessary information for the application of customs regulations, and carry out the associated formalities.
They can act under two modes of representation:
- Direct representation: the RCR acts in the name and on behalf of their client;
- Indirect representation: the RCR acts in their own name but on behalf of their client.
Prior registration is mandatory for operators wishing to carry out direct or indirect customs representation activities.
Context of intervention
The RCR can intervene, on behalf of their clients, in operations requiring the completion of customs formalities, including:
- Import and export customs declarations;
- Operations falling under specific customs procedures;
- Transmission and management of customs data and formalities on behalf of third parties;
- Formalities related to customs and security arrangements, according to authorisations and the type of representation.
RCR: what are the responsibilities?
The activity of an RCR notably involves:
- Complying with registration obligations and informing customs of any changes likely to affect this registration;
- Possessing the professional skills necessary to carry out the activity;
- Guaranteeing the reliability and accuracy of information transmitted to customs in the course of their duties;
- Complying with customs obligations and applicable deadlines for operations processed on behalf of their clients;
- Ensuring the traceability and retention of documents and information in accordance with applicable obligations.
The responsibilities of the RCR depend notably on the chosen mode of representation (direct or indirect) and the nature of the formalities completed.
